Motor & Vehicles

Buying a vehicle, finance, dealer disputes, misrepresentation, faulty goods, motor ADR and Financial Ombudsman routes.

Choose the external route.

The Motor Ombudsman covers subscribing businesses and uses early resolution, mediation/adjudication and an Ombudsman final-decision structure. Finance complaints may instead or additionally fall within FOS. Court remains a separate route where appropriate.

Evidence condition and chronology.

Record the advert, mileage, inspection, diagnostic reports, repair attempts, recovery costs, warning lights and dates the vehicle was unavailable. If the dealer says the fault was caused by misuse or ordinary wear, an independent technical report can become important.

Buying the vehicle and financing it are separate questions.

A faulty vehicle can engage Consumer Rights Act remedies against the seller. Hire purchase, PCP or other regulated finance may create additional rights and a Financial Ombudsman route against the finance provider. A manufacturer warranty is another promise again.

What this hub is for.

A vehicle dispute may involve the dealer, manufacturer, warranty provider and finance company at the same time. Keep those relationships separate because your legal rights and ombudsman routes can differ.

Do not collapse different problems into one complaint.

Separate the underlying transaction or service dispute from any data-protection, credit-reporting, complaint-handling or professional-conduct issue. They can arise from the same events while using different legal frameworks and different escalation routes. This separation is one of the easiest ways to keep a complex case understandable.

Vehicle purchase, repair, warranty, finance and insurance disputes can use different bodies.

A faulty vehicle purchased from a trader raises consumer-rights questions about quality, description and remedies. A poor repair raises service and workmanship issues. A manufacturer or warranty complaint may fall within The Motor Ombudsman only where the business and subject matter are covered by its Codes. Car finance and motor insurance complaints instead usually sit within the regulated financial-services route and may go to FOS.

The Motor Ombudsman currently requires the consumer to complain to the accredited business first and normally allows the business up to eight weeks to provide its final answer. It cannot take every motor dispute, so check accreditation and scope before waiting for that route.

Evidence condition and causation.

Keep the advert, order form, invoice, inspection reports, MOT records, diagnostic printouts, photographs, repair invoices, warranty wording and communication about the fault. Where there is a dispute about whether a fault existed at purchase or was caused later, expert or technical evidence can become important.
